Introduction

The Department of Labor, Licensing and Regulation (DLLR), Division of Labor and Industry is accepting applications from qualified candidates for two (2) Wage and Hour Investigator II positions.  The current vacancies are in the Prevailing Wage Unit.  The certified eligible list established for this classification will be used by DLLR to fill this vacancy and may be used to fill similar positions in other units within the Division of Labor and Industry for a period of one year.   Persons interested in these positions and/or future positions in this classification should apply at this time.

Main Purpose of Job

Enforces compliance of the Maryland Prevailing Wage procurement laws §§17-201 -17-226 and COMAR 21.11.11 by conducting field investigations, company interviews, employee interviews, background checks, UI data search for tax compliance, audits of certified payroll reports for underpayment of wages and bonafide fringe, establish that fringe benefit payments are contributed to a bonafide fringe plan, call any third party benefit provider requesting records, confirm with the banking industry that benefits are paid and secured for the employees, investigate underpayment wage and fringe claims filed by employees, investigate misclassification by interviewing, taking pictures, reviewing the apprenticeship standards for a clear definition of craft jurisdiction and follow through with recovering any monies due to employees by issuing a demand letter to General Contractor/ subcontractor, assist with survey to establish annual required wage and fringe rate paid to employee.

Prepare cases for the Attorney General’s office to prosecute, prepare his/her testimony, and prepare his /her witnesses.

Conduct pre-construction meetings (outreach) with General/subcontractors on all assigned projects by giving an overview of the laws and regulations that govern the Prevailing Wage jobsites.

MINIMUM QUALIFICATIONS

Education: Graduation from an accredited high school or possession of a high school equivalency certificate.

Experience: Four years of general investigative work. For the II level, two years of the experience must have involved investigations for compliance to laws and regulations governing wages and/or employment practices.

Notes: 

1. Additional years of experience as stated above may be substituted on a year-for-year basis for the required education.

2. Candidates may substitute U.S. Armed Forces military service experience as a non-commissioned officer in the inspection, investigation, enforcement and compliance classifications inspection, investigation, enforcement and compliance specialty codes in the wage and hour investigation field of work on a year-for-year basis for the required experience.

SELECTIVE QUALIFICATIONS

Performs site investigation, employee interview, employer conferences at construction sites; interviews and photographs employees while working to determine compliance with the craft classifications listed in the Prevailing Wage Law. Conducts pre-construction meetings where he/she interprets the laws and regulations. Looks at tax avoidance by employers using 1099 Independent Contractor status and misclassification. The investigator must issue a charge letter to the General Contractor/subcontractor and access the Liquidated Damages approximated for the violation. Each investigator must maintain contact with the employees that have filed claims of underpayment.  

Examines and reviews payroll records for public work contracts. Each investigator is responsible for approximately 30,000 to 45,000 certified payrolls which encompass the case workload.    

Determines wages and fringes due employees including overtime and collects monies owed, any penalties assessed as a result of an audit, issuing charge letters. Investigator must have operating knowledge of Excel and Access work processes. Sends check and deposit slip for employee payment to State Comptrollers’ office. Enforces apprenticeship to journeyman ratio onsite.    

Prepares and presents detailed report of findings and recommends appropriate action: to Supervisor, Administrator, and Assistant Attorney General. Prepares site reports for State Stats monthly.  

Cites and interprets Prevailing Wage Law and Regulations to Employers, employees, and other interested parties for the purpose of preventing violations. Public outreach and education.  

Testifies at Administrative Hearings regarding investigation findings. Assist in preparation of charging documents for submission to Attorney General’s Office. Follows through on any restitution recovery to deposit employees money with the State Comptrollers’ office for payout.  

DESIRED OR PREFERRED QUALIFICATIONS

Experience working within a regulatory and codified environment; reviewing, researching, and applying standards and regulations; report writing experience, and investigative background/skills.  

Bilingual in English and Spanish.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

Employees in these classes may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator's license valid in the State of Maryland.

SPECIAL REQUIREMENTS

Employees in these classes may be required to have daily use of a motor vehicle while on official State business. Standard mileage allowance will be paid for use of a privately owned vehicle.

All candidates are subject to a background check against files maintained by the Division of Unemployment Insurance (DLLR/DUI) to determine whether any monies are owed to DLLR/DUI as a result of an unemployment insurance overpayment and/or fraud.  Any unpaid debt may have an impact on whether or not a candidate is offered employment.

Applicants that meet the minimum qualifications will be referred to the hiring unit for interview selection.  Units will select candidates to interview who most closely demonstrate their qualifications.

BARGAINING UNIT STATUS

The incumbent in this position is a member of a covered bargaining unit and will be required to pay a bi-weekly service fee to the exclusive representative of the bargaining unit.
