Introduction

The Department of Labor, Licensing and Regulation is accepting applications from qualified candidates for an Administrative Officer III position within the Office of Labor and Industry, Worker Classification Protection Unit.  This recruitment is open to current permanent and contractual employees of the Department of Labor, Licensing and Regulation only.

Main Purpose of Job

The main purpose of this job is to investigate the labor practices of work providers in the construction and landscaping industries and to identify situations in which an individual is being misclassified as an "independent contractor" when they are in fact an employee.

POSITION DUTIES

The duties of this position include, but are not limited to, the following:

Explaining the Workplace Fraud Act to workers and work providers to he help workers understand why proper classification is important to them and to help work providers figure out if they are properly classifying their workers

Investigating retail workers and store managers for potential violations of the Healthy Retail Employee act, making initial assessments and initiating an informal resolution if applicable

Investigating potential violations of the Job Applicant Fairness Act, making initial assessments and initiating an informal resolution if applicable

Solving problems independently and making analytical determinations in order to gather testimony and other evidence of possible labor law violations

Providing training to workers and work providers on the requirements of the Workplace Fraud Act and how to become compliant therewith

MINIMUM QUALIFICATIONS

Education: Possession of a bachelor's degree from an accredited four-year college or university.

Experience: Three years experience in administrative or professional work.

Notes:

1. Candidates may substitute additional experience in administrative staff or professional work on a year-for-year basis for the required education.

 2. Candidates may substitute additional graduate level education at an accredited college or university at the rate of 30 semester credit hours for each year of the required experience.

3. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer involving staff work that included the regular independent judgment and analysis in applying and interpreting complex administrative plans, policies, rules or regulations or analysis of operational programs or procedures with recommendations for improvement on a year to year basis for the required education and experience.  

SELECTIVE QUALIFICATIONS

This recruitment is limited to current contractual employees of the Department of Labor, Licensing and Regulation.

DESIRED OR PREFERRED QUALIFICATIONS

Degree in Criminal Justice or Degree/Certificate in Paralegal Studies

Experience as a law enforcement officer, paralegal, and/or legal secretary

Experience conducting investigations

Bilingual in English and Spanish

LICENSES, REGISTRATIONS AND CERTIFICATIONS

Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator’s license valid in the State of Maryland.

SPECIAL REQUIREMENTS

All candidates are subject to a background check against files maintained by the Division of Unemployment Insurance (DLLR/DUI) to determine whether any monies are owed to DLLR/DUI as a result of an unemployment insurance overpayment and/or fraud. Any unpaid debt may have an impact on whether or not a candidate is offered employment.

SELECTION PROCESS

Applicants must provide sufficient information on the application to show they meet the qualifications for this recruitment.  All information concerning the qualifications, including any required documentation (diploma, transcript, certificate, etc.) must be submitted and received by the closing date. Information submitted after this date will not be considered. Successful applicants will be placed on a certified list categorized as Best Qualified, Better Qualified or Qualified. The certified list will be used by DLLR for a period of one year.

EXAMINATION PROCESS

The examination will consist of a rating of your education, training, and experience as presented on your application and as they relate to the requirements of the position. You may be asked to complete a supplemental questionnaire. The supplemental questionnaire may be used as part of the rating process. Therefore, it is important that you provide complete and accurate information on your application.

BARGAINING UNIT STATUS

The incumbent in this position is a member of a covered bargaining unit and will be required to pay a bi-weekly service fee to the exclusive representative of the bargaining unit.

Military Veterans may qualify for additional bonus points towards certification. A copy of your proof of eligibility (DD 214) for Veterans’ Credit must be in this office and completely verified before Veterans’ Credit will be approved.  Permanent State employees do not need to submit proof of eligibility for Veterans’ Credit.
