Main Purpose of Job

This is the entry level wage and hour investigator position. Enforces compliance of the Maryland Prevailing Wage procurement laws §§17-201 -17-226 and COMAR 21.11.11 by conducting field investigations, company interviews, employee interviews, background checks.

POSITION DUTIES

Will learn to perform site investigation, employee interview, employer conferences at construction sites; interviews and photographs employees while working to determine compliance with the craft classifications listed in the Prevailing Wage Law. Conducts pre-construction meetings where he/she interprets the laws and regulations. The investigator must issue a charge letter to the General Contractor/subcontractor and access the Liquidated Damages approximated for the violation. Each investigator must maintain contact with the employees that have filed claims of underpayment.

 

Will become familiar with how to examine and review payroll records for public work contracts. Each investigator is responsible for approximately 30,000 to 45,000 certified payrolls which encompass the case workload.

 

Determines wages and fringes due employees including overtime and collects monies owed, any penalties assessed as a result of an audit, issuing charge letters. Investigator must have operating knowledge of Excel and Access work processes. Sends check and deposit slip for employee payment to State Comptrollers’ office. Enforces apprenticeship to journeyman ratio onsite.

 

 

Learns how to prepare and present detailed report of findings and recommends appropriate action: to Supervisor, Administrator, and Assistant Attorney General. Prepares site reports for State Stats monthly.

 

Becomes familiar with and how to cite and interpret Prevailing Wage Law and Regulations to employers, employees, and other interested parties for the purpose of preventing violations. Public outreach and education.

 

Testifies at Administrative Hearings regarding investigation findings. Assist in preparation of charging documents for submission to Attorney General’s Office. Follows through on any restitution recovery to deposit employees money with the State Comptrollers’ office for payout.

 

Performs other duties as assigned by management.

MINIMUM QUALIFICATIONS

Education: Graduation from an accredited high school or possession of a high school equivalency certificate.

Experience: Two years of general investigative work.

Notes: 

1. Additional years of experience as stated above may be substituted on a year-for-year basis for the required education.

2. Candidates may substitute U.S. Armed Forces military service experience as a non-commissioned officer in the inspection, investigation, enforcement and compliance classifications inspection, investigation, enforcement and compliance specialty codes in the wage and hour investigation field of work on a year-for-year basis for the required experience.    

DESIRED OR PREFERRED QUALIFICATIONS

Experience working within a regulatory and codified environment; reviewing, researching, and applying standards and regulations; report writing experience, and investigative background/skills. Excellent verbal, analytical, organizational and written skills. Investigative and report writing experience.

Ability to speak and write fluent Spanish is preferred.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

Employees in these classes may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator's license valid in the State of Maryland.

SPECIAL REQUIREMENTS

All candidates are subject to a background check against files maintained by the Division of Unemployment Insurance (DLLR/DUI) to determine whether any monies are owed to DLLR/DUI as a result of unemployment insurance overpayment/fraud. Any unpaid debt may have an impact on whether or not a candidate is offered employment.

Employees in these classes may be required to have daily use of a motor vehicle while on official State business. Standard mileage allowance will be paid for use of a privately owned vehicle.

BARGAINING UNIT STATUS

The incumbent in this position is a member of a covered bargaining unit and will be required to pay a bi-weekly service fee to the exclusive representative of the bargaining unit.

U.S. Military Veterans may qualify for additional bonus points towards certification. Any job offer will be contingent on the candidate providing a U.S. Military form DD 214 verifying honorable discharge from service prior to starting employment (and may be requested prior to interview). Permanent State employees do not need to submit proof of Veterans’ status.
